1. Acceptance of Terms
By accessing the Savard Digital website (savarddigital.com), booking a strategy call, or engaging Savard Digital (“we,” “us,” “our”) for services, you (“you,” “Client”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our website or engage our services.
These Terms constitute a binding legal agreement between you and Savard Digital.
2. Services Offered
Savard Digital provides productized acquisition infrastructure services for B2B SaaS companies, including search engine optimization (SEO), generative engine optimization (GEO), AI-powered content production, automated content repurposing, backlink acquisition, real-time visibility tracking, and related advisory services.
The flagship service is the 90-Day Growth System (“Engagement”), described in detail in Section 4.
3. Eligibility
Our services are intended for B2B SaaS businesses operating in good faith with annual recurring revenue between $500,000 and $5,000,000 USD (or equivalent), located in jurisdictions where our services are legally permitted. By engaging us, you represent and warrant that you have the legal authority to bind your business to these Terms and that all information you provide at engagement kickoff is accurate.
4. Engagement Terms & Guarantee Trigger
4A. The Engagement
The 90-Day Growth System (“Engagement”) is a fixed-scope service engagement defined as follows:
- Term: 90 calendar days from the kickoff date
- Fee: [PENDING OFFER DOC. final price/structure to be inserted from offer doc when available]
- Deliverables: foundation and content strategy build (Phase 1, Weeks 1 to 2); content engine deployment with automated content production, repurposing, and authority-building (Phase 2, Weeks 3 to 8); compounding visibility phase with live tracking dashboard (Phase 3, Weeks 9 to 12)
- Bi-weekly support sessions included throughout the 90-day Engagement
- Real-time performance dashboard delivered live by Week 3 of the Engagement, providing visibility into Google rankings, organic traffic, and AI search citation tracking
4B. The Guarantee Trigger. ChatGPT Ranking
Savard Digital guarantees that, within 90 days of Engagement kickoff, the Client's brand will be “Ranked in ChatGPT” as defined below.
“Ranked in ChatGPT” means: the Client's brand or domain appears as a recommended, cited, or referenced entity in the generated response of the OpenAI ChatGPT consumer product when prompted with at least one (1) query from the Locked Query List defined in Section 4C below, evaluated under the measurement protocol in Section 4D.
The threshold for the guarantee to be considered met is at least one (1) qualifying query from the Locked Query List producing a Ranked outcome at the day-90 evaluation.
The 90-day Engagement is delivered with a target of three (3) or more qualifying queries producing a Ranked outcome. This represents the typical performance Savard Digital aims to deliver. The minimum threshold of one (1) qualifying query represents the floor below which the guarantee remedy in Section 4E activates.
4C. The Locked Query List
At Engagement kickoff (Phase 1, Weeks 1 to 2), Savard Digital and Client jointly define a written list of between five (5) and ten (10) buyer-intent queries. These are natural-language questions a Client's prospective buyer would plausibly ask ChatGPT during product research or evaluation.
Once locked in writing and signed off by both parties at the end of Phase 1, the Locked Query List is the sole basis for Ranked-in-ChatGPT measurement. Queries cannot be added, removed, or modified after lock without written agreement from both parties.
Queries must meet the following criteria to be eligible for the Locked Query List:
- The query is a question or research prompt a real prospective buyer would plausibly type into ChatGPT
- The query is reasonable in scope (not “best company in the world” or other unreasonably broad superlatives)
- The query is in English (additional language support requires separate written agreement)
- The query relates to the Client's defined product category, ICP, and target market as established at kickoff
4D. Measurement Protocol
At day 90 of the Engagement (or at any subsequent evaluation point if the Engagement extends under Section 4E), Savard Digital evaluates the Locked Query List as follows:
- For each query in the Locked Query List, the query is run five (5) times in independent fresh ChatGPT sessions (using new accounts, cleared cookies, no chat history) within a single 7-day evaluation window
- A query is considered to produce a Ranked outcome if the Client's brand or domain appears as a recommended, cited, or referenced entity in at least three (3) of the five (5) sessions (60% citation rate or higher) for that query
- The five-session evaluation is documented via screenshots and timestamps and provided to Client as part of the day-90 evaluation report
This measurement protocol exists to control for the inherent variability of large language model output across sessions. The panel approach establishes whether the ranking is structural, not incidental.
4E. Guarantee Remedy (Effort Continuation)
If the Ranked-in-ChatGPT threshold (at least one (1) qualifying query producing a Ranked outcome under the Section 4D measurement protocol) is not met at the day-90 evaluation, Savard Digital will continue performing all Engagement services at no additional charge until the threshold is met, subject to the conditions in Section 4G (Engagement Void Conditions) and Section 6 (Termination).
4F. Forward-Looking Outcomes (Stated, Not Guarantee Triggers)
The Engagement is also designed to produce, but does not guarantee:
- Increases in organic search traffic from Google and other search engines (Savard Digital's typical delivery is 100% to 150%+ increases over baseline within 90 days, but this is not the trigger condition for the guarantee)
- Top-3 Google rankings for buyer-intent keywords
- Visibility in additional AI assistants including Google Gemini, Perplexity, and Claude
- Increases in inbound demo bookings, qualified leads, and pipeline value
These outcomes are tracked on the live Engagement dashboard delivered in Week 3 and are reported to Client throughout the Engagement, but only the Section 4B Ranked-in-ChatGPT trigger activates the Section 4E remedy.
4G. Engagement Void Conditions
The Ranked-in-ChatGPT guarantee is void if Client:
- Fails to provide timely access to the domain, analytics platform, content management system, or other systems required for Engagement delivery (within 5 business days of request)
- Fails to attend the Phase 1 extraction call within 14 days of Engagement kickoff
- Fails to participate in the Locked Query List definition session in Phase 1 such that the Locked Query List cannot be finalized within 21 days of Engagement kickoff
- Refuses or fails to approve Engagement-published content for more than 30 cumulative days during the Engagement period
- Removes, modifies, or alters Engagement-deployed content, backlinks, or dashboard infrastructure during the Engagement period
- Engages another party to perform conflicting SEO, content, or domain authority work during the Engagement period without prior written approval from Savard Digital
- Provides inaccurate or fraudulent information about the business at Engagement kickoff
- Operates outside the B2B SaaS category as established at Engagement kickoff
In the event of Engagement void, Engagement terminates effective immediately, no refunds apply for services rendered, and Savard Digital releases all guarantee obligations.
5. Payment Terms

6. Termination
Either party may terminate the Engagement at any time for material breach of these Terms by the other party, provided written notice is given and a 14-day cure period is allowed (where cure is possible). Savard Digital may terminate the Engagement immediately if Client engages in any conduct described in Section 4G (Engagement Void Conditions).
Upon termination: Client retains ownership of all deliverables produced and approved prior to termination. Savard Digital retains ownership of underlying methods, templates, and proprietary tools. Outstanding fees for services rendered through the termination date remain payable. The Section 4B guarantee obligations terminate.
7. Intellectual Property
Client retains ownership of all content, knowledge base inputs, brand assets, and other materials provided by Client to Savard Digital. Upon completion of the Engagement and full payment of all fees, Client owns all final deliverables produced specifically for Client during the Engagement, including published content, knowledge base outputs, and acquired backlinks attributable to Client's domain.
Savard Digital retains ownership of: underlying methodologies, content production frameworks, AI agent configurations, dashboard infrastructure templates, and any other proprietary tools or processes developed by Savard Digital independent of Client's Engagement. Savard Digital may use anonymized, aggregated learnings from Engagements to improve services, provided no Client-identifying information is disclosed.
8. Confidentiality
Each party agrees to maintain the confidentiality of any non-public information disclosed by the other party during the Engagement, including business plans, financial information, customer data, and proprietary methodologies. Confidentiality obligations survive termination of these Terms for a period of three (3) years.
Confidentiality obligations do not apply to information that: (a) is publicly available through no breach of these Terms; (b) was lawfully known to the receiving party prior to disclosure; (c) is independently developed without use of the disclosing party's confidential information; or (d) is required to be disclosed by law or court order.
9. Service Availability
Savard Digital makes commercially reasonable efforts to maintain service availability throughout the Engagement, including dashboard uptime and timely delivery of weekly content. We reserve the right to modify, suspend, or discontinue any aspect of our services at our discretion, with reasonable notice to active Engagement Clients where modifications materially affect Engagement delivery.
10. Disclaimers
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR THE SPECIFIC GUARANTEE PROVIDED IN SECTION 4B AND THE REMEDY PROVIDED IN SECTION 4E, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING OUR SERVICES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that our services will be uninterrupted, error-free, or produce specific business outcomes beyond the Section 4B guarantee. Search engine algorithms, AI search algorithms, and third-party platform behaviors are outside our control and may change at any time.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAVARD DIGITAL'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE ENGAGEMENT SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT TO SAVARD DIGITAL UNDER THE APPLICABLE ENGAGEMENT.
IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The Section 4E effort-continuation remedy is the sole and exclusive remedy for failure to meet the Section 4B guarantee.
12. Indemnification
Client agrees to indemnify and hold harmless Savard Digital, its officers, employees, and contractors from any claims, damages, or liabilities arising out of: (a) Client's breach of these Terms; (b) Client's misuse of our services; (c) Client's violation of any applicable law; or (d) infringement claims arising from materials provided by Client to Savard Digital for use in the Engagement.
13. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify active Engagement Clients by email. Continued use of our services after changes take effect constitutes acceptance of the updated Terms. Material changes do not retroactively modify the terms of an active Engagement without written agreement from Client.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Quebec, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Engagement shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration in Montreal, Quebec, conducted in English under the rules of the ADR Institute of Canada. The arbitration award shall be final and binding on both parties.
Notwithstanding the above, either party may seek injunctive or equitable relief from a court of competent jurisdiction in Quebec for actual or threatened breach of confidentiality or intellectual property obligations.
